Terms of service
TERMS & CONDITIONS
Effective Date: 9 August 2026
Welcome to DéSholé. These Terms & Conditions govern your use of our website and the purchase of products from DéSholé. Throughout these Terms, “DéSholé”, “we”, “us” and “our” refer to DeSholé Limited. By using our website or placing an order with us, you agree to these Terms.
Nothing in these Terms affects your statutory rights as a consumer.
1. Our Brand
DéSholé is a fashion brand operated by DeShole Limited. We offer clothing and fashion products through our online store.
We reserve the right to update these Terms from time to time. The version published on our website at the time you place your order will apply to that order.
2. Eligibility
By placing an order through our website, you confirm that you are legally capable of entering into a binding contract and that the information you provide to us is accurate and complete.
If you are under 18, you should only use our website with the involvement of a parent or guardian.
3. Products
We make reasonable efforts to display and describe our products accurately, including colours, measurements, materials and other details.
However, colours may appear slightly different depending on your device or screen settings, and minor variations may occur between products.
Product availability is subject to change, and we may withdraw or discontinue products without notice.
4. Product Sizing
Customers are responsible for reviewing the product description and available sizing information before ordering.
Where measurements or size guidance are provided, they are intended to help customers select an appropriate size. Small variations may occur depending on the style, fabric and construction of a garment.
5. Prices
Prices displayed on our website are shown in the currency applicable to your market where supported.
Prices may change from time to time. A price change will not affect an order that we have already accepted.
Any applicable delivery charges, taxes, duties or other charges will be shown or communicated where required before you complete your purchase.
6. Orders
When you place an order, you are making an offer to purchase the products in your basket.
Receiving an order confirmation does not necessarily mean that we have accepted your order. A contract is formed when we accept and process your order in accordance with our checkout and fulfilment process.
We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, there is an obvious pricing or description error, payment cannot be authorised, or we reasonably suspect fraud or misuse.
If we cancel an order after payment has been taken, we will refund the amount due.
7. Payment
Payment must be made using one of the payment methods available at checkout.
Payments may be processed by Shopify Payments, PayPal or other payment providers made available through our store. Payment providers may apply their own terms and privacy policies.
You confirm that you are authorised to use the payment method provided for your order.
8. Promotions and Discount Codes
From time to time, DéSholé may offer promotional codes, discounts or special offers.
Unless otherwise stated, promotions cannot be exchanged for cash and may not be used in conjunction with other offers. We may set expiry dates, minimum spends, product exclusions or other reasonable conditions.
We reserve the right to withdraw or amend a promotion where necessary, without affecting orders already validly placed using that promotion.
9. Delivery
Available delivery methods, estimated delivery times and shipping charges are displayed at checkout where applicable.
Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control.
Please ensure that your delivery address is complete and accurate when placing your order. If you notice an error, contact us as soon as possible. We cannot guarantee that an address can be changed once an order has entered fulfilment.
Nothing in this section limits any rights you have under applicable consumer law where goods are delivered late or are not delivered.
10. International Orders
We may offer delivery to selected countries and regions outside the United Kingdom.
Available products, prices, currencies, shipping methods, taxes and duties may vary according to the customer’s location.
Where duties, import taxes or other charges apply, responsibility for those charges will be determined by the information presented at checkout and applicable law.
11. Returns and Cancellation Rights
Our Return and Refund Policy forms part of these Terms.
For eligible UK online purchases, you generally have 14 days from the day you receive your goods to tell us that you wish to cancel. Once you have told us, you then generally have a further 14 days to send the goods back.
Please follow the return instructions provided in our Return and Refund Policy.
Nothing in these Terms or our Return and Refund Policy affects your statutory rights, including your rights relating to faulty, damaged, incorrectly supplied or misdescribed goods.
12. Return Shipping and Refunds
Unless otherwise required by law or stated by us, customers are responsible for arranging and paying for return shipping for change-of-mind returns.
Where goods are faulty, damaged or incorrectly supplied, your statutory rights apply.
Refunds will be handled in accordance with our Return and Refund Policy and applicable consumer law.
13. Ownership and Risk
Ownership of products passes to you when we have received payment in full and the products have been supplied to you in accordance with applicable law.
Responsibility for goods will pass in accordance with applicable consumer law.
14. Intellectual Property
The content of our website, including the DéSholé name and branding, logos, graphics, photographs, product images, text, designs and other materials, is owned by or licensed to us unless otherwise stated.
You may not reproduce, distribute, modify, commercially exploit or use our intellectual property without prior written permission, except where permitted by law.
15. Acceptable Use
You must not misuse our website or knowingly introduce viruses, malicious code or other harmful material.
You must not attempt to gain unauthorised access to our website, systems or customer information, use the website for fraudulent or unlawful purposes, or interfere with its normal operation.
16. Reviews and User Content
Where our website allows customers to submit reviews, photographs, comments or other content, you must ensure that your content is lawful, accurate where it states facts, and does not infringe another person’s rights.
We may moderate or remove content where reasonably necessary, including content that is unlawful, abusive, fraudulent, misleading, infringing or unrelated to the relevant product or service.
17. Third-Party Links and Services
Our website may contain links to third-party websites or use services provided by third parties.
We are not responsible for third-party websites or services that we do not control. You should review their applicable terms and privacy policies before using them.
18. Website Availability
We aim to keep our website available and functioning correctly, but we cannot guarantee uninterrupted or error-free access at all times.
We may temporarily suspend, restrict or modify parts of the website for maintenance, security, technical or operational reasons.
19. Limitation of Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability arising under applicable consumer protection law.
Nothing in these Terms affects your statutory rights as a consumer.
To the fullest extent permitted by law, DéSholé will not be liable for losses that were not reasonably foreseeable when the contract was formed, or for business losses suffered by a customer acting as a consumer.
20. Force Majeure
We will not be responsible for delay or failure to perform our obligations where this results from events outside our reasonable control.
Such events may include severe weather, natural disasters, transport disruption, strikes, governmental action, war, civil disturbance, telecommunications or internet failures, or other events that we could not reasonably prevent.
This does not affect any rights you have under applicable consumer law.
21. Privacy
Your personal information is handled in accordance with our Privacy Policy and applicable data protection legislation.
Please read our Privacy Policy for information about how personal information is collected, used, shared and protected.
22. Fraud Prevention
We reserve the right to carry out reasonable fraud-prevention and security checks in connection with orders and payments.
We may delay, refuse or cancel an order where we reasonably suspect fraud, unauthorised payment activity or other unlawful conduct.
23. Chargebacks and Payment Disputes
If you believe there is a problem with an order or payment, please contact us so that we have an opportunity to investigate and resolve the matter.
Nothing in this section prevents you from exercising any lawful rights available through your card issuer, payment provider or applicable consumer law.
24. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also benefit from mandatory protections provided by the laws of the country in which you live. Nothing in these Terms deprives you of those protections.
Any dispute will be subject to the jurisdiction of the courts applicable under relevant consumer law.
25. Amendments
DéSholé reserves the right to amend these Terms from time to time. Updated Terms will apply from the date they are published on our website and will not retrospectively alter the terms applicable to orders already placed, unless required by law.
26. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
27. No Waiver
If we delay or fail to enforce any provision of these Terms, this does not mean that we waive our right to enforce that provision or any other right later.
28. Entire Agreement
These Terms, together with our Return and Refund Policy, Privacy Policy and any other terms expressly applicable to your order, form the agreement between you and DéSholé relating to your purchase.
Nothing in this section limits liability for fraud or fraudulent misrepresentation or affects rights that cannot legally be excluded.
29. Contact Us
If you have any questions about these Terms, an order or your rights as a customer, please contact DéSholé using the contact details provided on our website.
